Your lawyer will do a title search of the property to ensure that there are no unanticipated “surprises” registered against your property – sellers’ mortgages, unpaid historical property taxes, builders’ liens, and certificates of pending litigation must all be dealt with to ensure that you obtain clear title. Your lawyer will make sure that these issues are addressed by the seller and removed before the completion date.
Financing your purchase? You must also ensure that the lawyer you choose to represent you is approved by your bank or credit union. If not, you will be unable to use that lawyer, or you may have to pay for the services of two lawyers.
